Copyright Policy

Purpose

 The purpose of this policy is to establish Bridgewater State College's policy on copyright ownership and define the administrative procedures for implementing and enforcing the policy.

Policy Statement
Bridgewater State College requires all users of the college network to comply with all state and federal laws, including copyright laws. Members of the BSC Community have access to the fundamentals of copyright law and a guide to copyright information at the Clement C. Maxwell Library Web page and and the United States Copyright Office Web page.  

Applies to
This policy applies to all members of the Bridgewater State College community. This policy does not supersede any existing College policy.

Responsibilities
Everyone using the Bridgewater State College network must comply with the Digital Millenium Copyright Act, Title II, Section 512(c)(3).

Notification of Claimed Infringement Under The Digital Millennium Copyright Act:
If any owners of copyrights believe a member of the BSC community is infringing copyright protected work, they may send a notice to BSC's designated agent.  The College's agent is registered with the U.S. Copyright Office, and the listing of agents is available on-line at http://www.loc.gov/copyright/onlinesp/list/index.html. Notifications of claimed infringement must contain the information required by and otherwise comply with the Digital Millennium Copyright Act, Title II, Section 512(c)

The Information Technology Division at BSC will investigate allegations of copyright infringement and notify Academic Affairs of all valid notifications of claimed infringement received by BSC for appropriate action.

The agent, in consultation with the Chief Information Officer (CIO), will make the determinations regarding responses to complaints alleging copyright infringement, including whether the institution wishes to use the DMCA procedures and whether a notice received is sufficient under the law.

Sanctions
BSC reserves the right to choose how to address or respond to any allegation of copyright infringement received including, without limitation, the choice of any defense under applicable law.  Details on how BSC responds to allegations of on-line infringement of copyright, posted online at http://it.bridgew.edu/Policy/DMCA.cfm.
